This Buyer-Seller Agreement (“Agreement”) governs the relationship between users of the ExtraMarket platform, including sellers, buyers, and the platform operator. By accessing or using ExtraMarket(https://extramarket.in), you agree to abide by the terms and conditions stated herein.
For the purpose of this Agreement:
These definitions apply throughout this Agreement and are used to clarify the roles and responsibilities of each party involved in the transaction.
This Agreement outlines the roles, rights, and responsibilities of Sellers, Buyers, and ExtraMarket as a platform provider. It applies to all activities conducted on or through ExtraMarket, including but not limited to the listing, sale, purchase, payment, delivery, dispute resolution, and return of goods.
By using the platform, both Buyers and Sellers agree to be legally bound by the terms contained herein, in addition to complying with all applicable laws and regulations of India. This Agreement is supplemental to any other policies hosted on the website, including but not limited to the Privacy Policy, Terms of Service, and Return & Refund Policy.
Sellers on ExtraMarket.in must adhere to the following terms and conditions when listing products for sale to ExtraMarket (DazyTech IT Services):
Buyers must provide accurate information during account creation and checkout, including contact details and shipping address. By placing an order on ExtraMarket, the Buyer agrees to pay the full purchase amount, including applicable shipping and handling charges.
Upon receiving the item, the Buyer is expected to inspect it and report any damage, defect, or misrepresentation within the specified return window, typically 24 hours. Buyers must not misuse the platform for fraudulent activities, such as false claims or deliberate returns of undamaged goods.
All transactions made on the platform are final unless covered under the Return & Refund Policy. Buyers are expected to treat Sellers with fairness and adhere to proper conduct in communication and dispute resolution.
Note: Buyers, ensure that your contact and address details are accurate at the time of signup and before placing any order. If there is any change to your contact or delivery address, please update it in your account settings before placing an order. Once an order is placed, the address cannot be changed, and the item will be delivered to the address provided at the time of order confirmation. To receive future deliveries at a different location, you must update your address before placing your next order.
All payments made on ExtraMarket must go through the designated payment gateway integrated into the platform. Sellers are not permitted to accept or solicit direct payments outside the platform, as doing so violates platform policies and puts both parties at risk. Any attempt to bypass the official payment process is a violation of platform policies and may result in suspension or permanent account deactivation.
Once a seller submits an item for sale and it passes the required quality inspection, ExtraMarket proceeds with the purchase based on the agreed price. The payment will be made directly to the seller’s verified bank account as per the account details provided during registration. Sellers are advised to double-check and ensure that their bank account details are accurate and updated to avoid payment failures.
ExtraMarket may apply a service fee or deduction depending on the item type, promotional category, or applicable handling charges. These deductions, if any, will be clearly communicated to the seller prior to transaction finalization.
Payments are typically initiated after the successful completion of quality verification by our internal team. However, ExtraMarket reserves the right to delay or withhold payment in cases where there are ongoing disputes, suspected fraudulent listings, delivery issues, or pending investigations related to the transaction or seller behavior.
Seller: Extramarket’s delivery partner is responsible for the pickup of the shipment. However, the seller is responsible for the packaging and originality of the product. The shipment must be dispatched within the timeframe agreed during listing or checkout. Packaging should be secure to avoid damage in transit.
Buyer: Buyers must ensure someone is available at the shipping address to receive the item. Any delay or non-delivery due to incorrect address, refusal to accept, or unavailability will be the responsibility of the Buyer unless proven otherwise.
ExtraMarket permits returns and refunds only under specific conditions, such as damaged items, incorrect products, or defective goods. Buyers must initiate the return request within 24 hours of receiving the item and follow the steps outlined in the platform’s Return & Refund Policy.
Once a return request is approved, the Buyer must ship the item back in its original condition and packaging. After the returned item is received and inspected, the refund will be processed through the original payment method.
Note for Sellers:
Once a product is sold to ExtraMarket and has passed our internal quality check, the transaction is considered final and non-reversible. Sellers transfer full ownership of the item to ExtraMarket upon successful pickup and quality verification. Therefore, sellers are not eligible for any refunds, returns, or requests to reclaim the item after the sale is complete. Payment will be processed as per the agreed terms and no further claims will be entertained regarding the sold product.
ExtraMarket operates as an intermediary platform where individual sellers can offer their products for evaluation and sale. Sellers list their items on the platform, and upon acceptance through a quality check, ExtraMarket may choose to purchase the item. Once acquired, the product is listed on the website for resale to prospective buyers.
There is no direct contractual or commercial relationship between the original seller and the end buyer. ExtraMarket acts as an independent purchaser and subsequently as a seller to the final consumer. Therefore, all post-sale obligations, returns, and customer support related to the buyer are handled solely by ExtraMarket.
ExtraMarket does not guarantee that any product submitted by a seller will be accepted for purchase or listed for resale. Acceptance depends on internal quality control checks, pricing evaluation, demand, and legal compliance. The platform also makes no commitment regarding the speed of resale or the success of listing performance.
ExtraMarket is not liable for any loss, damage, or consequential claims arising from a seller’s expectation of product acceptance, failure of a listing to go live, or delays in product assessment or payment. Additionally, ExtraMarket may suspend or terminate seller accounts found to be engaging in fraudulent activity, misrepresentation, sale of prohibited goods, or breach of platform policies.
All user-generated content, including item descriptions and photos, is subject to review and may be edited or removed by ExtraMarket without notice if found inaccurate, misleading, or non-compliant with platform guidelines.
All product listings, photos, brand names, and other content uploaded by Sellers remain the intellectual property of their respective owners. However, Sellers grant ExtraMarket a non-exclusive, royalty-free license to use, reproduce, display, and distribute this content for marketing and operational purposes.
ExtraMarket retains all rights to its website content, design, branding, software, and infrastructure. Users must not replicate or reuse any part of the website without explicit written permission.
Users also agree not to upload, post, or distribute any content that infringes upon the intellectual property rights of any third party.
ExtraMarket reserves the right to terminate, suspend, or restrict access to any account without prior notice in cases of:
Users may also request account termination by contacting support. However, pending transactions must be completed or resolved before such requests can be honored.
Upon termination, all user data may be deleted or archived as per the platform's Privacy Policy.
In case of any disputes, complaints, or concerns arising out of the sale, purchase, payment, or delivery of products through ExtraMarket, users are required to contact us directly by writing to support@extramarket.in. We aim to review and address all such matters in a fair and timely manner in line with our platform policies and operational guidelines.
In cases where a dispute cannot be settled internally, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, and governed by the laws of India. Both parties agree that the courts located in Punjab, India, shall have exclusive jurisdiction over any legal proceedings arising from such disputes.
This Agreement may be updated or modified from time to time to reflect changes in business operations, legal requirements, or platform features. Users will be notified of such changes via email or platform notifications.
Continued use of the website after changes are published constitutes acceptance of the updated terms. Users are advised to regularly review this page for the latest version.
