By accessing or using Extra Market (the “Platform”), you agree to comply with and be bound by these Terms and Conditions. These terms govern your use of our website, services, and any transactions made through the Platform. Please read them carefully. If you do not agree with any part of these Terms, you should not access or use the website or any of our services

These Terms form a legally binding agreement between you and Dazytech IT Services Pvt Ltd. Whether you are a guest, buyer, seller, or vendor, your usage of the platform implies your full and irrevocable consent to these terms. We may update or revise these Terms from time to time to reflect changes in our policies, services, or the law, and it is your responsibility to regularly check this page for updates.

Your continued use of Extra Market after any modifications to the Terms constitutes acceptance of those changes. We encourage all users to keep a copy of these Terms for their records and to consult with a legal professional if they have any questions regarding the implications of their usage rights and responsibilities under these Terms.

2. Eligibility and User Responsibilities

You must be at least 18 years old to register, buy, or sell on Extra Market. By using the Platform, you represent and warrant that you are competent to enter into legally binding agreements under Indian law. If you are using the Platform on behalf of a company or other legal entity, you must have the authority to bind such entity to these Terms and Conditions.

All users are required to provide accurate, complete, and up-to-date information during registration and while using the Platform. Any false or misleading information can result in suspension or termination of your account without prior notice. Users are solely responsible for maintaining the confidentiality of their account information and passwords. You agree to notify us immediately of any unauthorized access or suspected breach of your account.

You agree not to use the Platform for any illegal or unauthorized purpose, including but not limited to violating intellectual property rights, distributing malware, engaging in fraud, or manipulating listings. You must also ensure that all content you upload, post, or otherwise transmit through the Platform complies with applicable laws and regulations and does not violate the rights of any third party.

3. Marketplace Usage (Buyers & Sellers)
3.1 General Overview

ExtraMarket operates as a curated marketplace platform facilitating the sale and purchase of electronic items and appliances. All products listed on ExtraMarket have been acquired directly from verified sellers. These items undergo a mandatory quality inspection by our internal team before being listed for sale to buyers on the website. Buyers interact and transact exclusively with ExtraMarket, not with individual sellers

3.2 Seller Usage
  • Sellers must be legally competent to enter into a contract and must be the rightful owners of the items they offer to ExtraMarket.
  • Sellers are required to provide complete, truthful, and accurate product details including condition (new, used, or refurbished), defects (if any), specifications, images, and any applicable warranty information.
  • Items must be in a functional, sellable condition at the time of pickup.
  • A correct and accessible pickup address must be provided. Any failed pickups due to incorrect addresses may lead to cancellation of the seller’s listing or delay in processing.
  • All payments to sellers will be transferred only via bank transfer. Sellers must ensure their bank accodetails are accurate and up-to-date. Cash transactions are not permitted.
  • Once the product is picked up, quality-checked, and approved by ExtraMarket, the seller relinquishes ownership and cannot request a return or reversal of the transaction.
  • If any product is found damaged, non-functional, or not as described during the quality check or at buyer’s delivery, ExtraMarket reserves the right to reject the item and return it to the seller without payment.

Note: Since sellers sell directly to ExtraMarket (not the end buyer), they are not eligible for any returns or refunds once the transaction is confirmed and completed.

3.3 Buyer Usage
  • Buyers purchase directly from ExtraMarket and not from individual sellers.
  • All items displayed on the platform have been inspected and listed with accurate condition, photos, and technical descriptions.
  • Buyers are expected to review all details before making a purchase.
  • In case a product is found to be damaged or non-functional at the time of delivery, buyers have the right to return it immediately to the delivery executive
  • Refunds, if applicable, will be processed only through the original payment method used at checkout, subject to verification and return approval.
  • Buyers must not attempt to engage sellers directly or negotiate outside the platform.
3.4 Platform Rights

ExtraMarket reserves the right to accept or reject listings, delist any product, suspend accounts found to be in violation of the terms, or withhold payment in case of suspected fraud, misrepresentation, or policy violations.

4. Payment Terms and Fees
4.1 Buyer Payments

ExtraMarket supports a variety of secure payment methods to ensure a smooth purchasing experience. Buyers are required to pay the full amount at the time of checkout, which includes the product price, applicable taxes (such as GST), and any delivery or handling charges as clearly displayed. All payments are processed through trusted third-party payment gateways, and all sensitive financial data is encrypted for security purposes. While we strive to ensure a seamless experience, ExtraMarket shall not be held liable for delays or failures caused by external payment processors or banks.

4.2 Seller Payouts

Sellers will receive payments for their sold items only through bank transfers to accounts provided and verified by them.

  • Payouts will be initiated only after the successful delivery of the product to the buyer and post-verification of the product condition and transaction details.
  • The verification and processing period may take up to 7 business days from the date of final transaction confirmation.
  • It is the seller's responsibility to ensure that all bank account details submitted are correct and updated. ExtraMarket is not liable for any payout failures caused due to incorrect or outdated banking information.
4.3 Platform Charges and Fees

ExtraMarket may charge:

  • Listing fees for placing products on the platform,
  • Commission fees on successful sales, and
  • Service charges for additional support or promotional services.

All applicable charges, including relevant taxes, will be clearly communicated to the seller before listing or at the time of transaction. These fees may vary based on the product category, promotional offers, or service usage.

Failure to pay due charges may lead to penalties, suspension of account privileges, removal of product listings, or permanent deactivation of the seller's account.

Note: ExtraMarket reserves the right to revise its fee structure at any time. Any changes will be notified in advance through appropriate channels such as email or platform announcements.

5. Returns, Refunds, and Disputes

Our Return and Refund Policy is designed to protect both buyers and sellers. Buyers are encouraged to review the return window and terms before making a purchase. Items must be returned in their original condition, with all tags and packaging intact. Refunds are processed only after the item is received and verified by our team, depending on the item category.

Note for Sellers:

Once a product is sold to ExtraMarket and has passed our internal quality check, the transaction is considered final and non-reversible. Sellers transfer full ownership of the item to ExtraMarket upon successful pickup and quality verification. Therefore, sellers are not eligible for any refunds, returns, or requests to reclaim the item after the sale is complete. Payment will be processed as per the agreed terms and no further claims will be entertained regarding the sold product.

6. Intellectual Property Rights

All content published on Extra Market, including logos, graphics, UI designs, product templates, and text, is the intellectual property of Dazytech IT Services Pvt Ltd unless otherwise stated. Unauthorized copying, distribution, or reproduction of any platform content is strictly prohibited and may result in legal action.

Users retain the rights to the content they upload (e.g., product images, descriptions), but by uploading such content, they grant Extra Market a non-exclusive, worldwide, royalty-free license to use, reproduce, and display it in connection with the operation of the platform. This includes promotional materials, social media posts, and internal analytics.

You agree not to use any automated tools such as bots, scrapers, or crawlers to access or extract data from the Platform for commercial use. Any violation of our intellectual property rights or attempts to reverse-engineer our technology stack will result in immediate termination of your account and possible legal proceedings under applicable IP laws in India.

7. Limitation of Liability

Extra Market is a facilitator and does not directly sell products or services. While we aim to provide a smooth and secure experience, we make no warranties—express or implied—regarding the reliability, quality, or accuracy of listings or user conduct. You use the Platform at your own risk, and we shall not be liable for any direct or indirect damages arising from your use of the service.

We are not responsible for any loss of data, interruption in service, failed transactions, or unauthorized access to user accounts. While we employ robust security measures, no digital platform is entirely immune from breaches. Users are advised to maintain their own backups and use strong passwords to protect their accounts.

In jurisdictions where exclusion of liability is not allowed, our total liability shall not exceed the total amount paid by the user to Extra Market in the last three (3) months preceding the claim. This limitation shall apply to the fullest extent permissible under applicable laws of India.

8. Termination and Suspension

We reserve the right to suspend or terminate your account at any time, with or without prior notice, if you are found violating any of our terms or engaging in suspicious activity. This includes but is not limited to fraud, abuse, harassment, or intellectual property infringement. Repeat violations may result in permanent account deletion and a ban from future use.

Users can request account termination by contacting us at contact@extramarket.in. Upon termination, access to your account and all data associated with it will be permanently disabled. We may retain user data in accordance with our Privacy Policy and applicable laws for audit, legal, or operational purposes.

Termination of an account does not relieve users of any financial obligations or legal liabilities incurred prior to termination. Sellers with pending payouts will receive them only after fulfilling all due verification and compliance processes. We also reserve the right to take appropriate legal action against users whose behavior has caused harm to the platform or its community.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of India. By using Extra Market, you agree that any disputes or claims arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Punjab, India.

In the event of any legal proceedings, both parties agree to submit to the personal and exclusive jurisdiction of the courts of Punjab. This clause shall survive the termination or expiration of your use of the platform or any services offered herein. It is your responsibility to comply with local laws and regulations that may apply to your use of the platform.
